At MetricTuner, transparency is a core value. This document clearly explains what data we collect, how we use it, who we share it with and what rights you have over it.

Terms of Service

1. Service Description

MetricTuner is a SaaS marketing infrastructure and data intelligence platform for independent artists and their teams. The platform offers Smart Links, Content Gates, Pre-Saves, AI-powered ad campaigns, audience CRM, email marketing, professional audio services (mixing, mastering), distribution and global charts registration, plus organization tools for artists, features to collaborate with content creators and to submit music to playlists. MetricTuner charges its users for access to these software services.

2. Eligibility and Registration

To use MetricTuner you must be over 18 or of the minimum legal age in your jurisdiction. When creating an account, you guarantee that the information provided is truthful, current and complete. You are responsible for keeping your password confidential and for all activities carried out from your account. MetricTuner uses an Access Codes system for controlled onboarding of new users during the launch phase.

3. Plans, Payments and Subscriptions

MetricTuner offers subscription plans with monthly or annual billing: Free, Starter ($9.99/mo), Pro ($24.99/mo), Manager ($49.99/mo) and Label ($129.99/mo). Annual prices include a 20% discount. In addition to subscription plans, the platform offers one-time Booster Packs that never expire: email credit top-ups (Launch, Tour, Label/Festival) and credit top-ups for platform features. You can change or cancel your plan at any time from your settings panel. When you cancel, you keep access until the end of the billed period. We don't offer refunds for partial periods already consumed. Purchased Booster Pack credits are non-refundable but remain available in your account indefinitely. Payments are processed securely through Paddle, which acts as Merchant of Record and handles billing and applicable taxes. Compensation to collaborators who provide services on the platform is handled independently, outside the subscription gateway, through specialized payment providers.

4. Acceptable Use

You agree to use MetricTuner exclusively for legitimate purposes related to the promotion, management and distribution of music content for which you own the rights or have express authorization. The following is strictly prohibited:

  • Using the platform to distribute content that infringes third-party copyright.
  • Artificially manipulating metrics, streams or audience statistics.
  • Creating ad campaigns with misleading, fraudulent content or content that violates Meta, Google or TikTok policies.
  • Sharing access credentials with unauthorized third parties.
  • Attempting to access other users' data or accounts without authorization.
  • Using unauthorized bots, scripts or automated tools to interact with the platform.

5. Intellectual Property

All content you upload to MetricTuner (music, artwork, videos, metadata) remains your property. MetricTuner does not claim ownership rights over your content. You grant us a limited, non-exclusive and revocable license to display, distribute and process your content exclusively within the context of the services the platform offers (for example, showing your song's artwork on a public Smart Link).

6. Split Sheets, Contracts and Legal Documents

MetricTuner offers tools to generate Split Sheets and standard music industry contracts (Work For Hire, Management, Booking, NDA, Sync License and Distribution) with Click-Wrap digital signature verified by an OTP code sent to each signer's email. These documents constitute binding agreements between the signing parties. MetricTuner acts solely as a facilitating technology platform and is not a party to the agreements signed between users. Each signature includes an immutable audit trail recording IP, date, time and verification method; OTP codes expire after 10 minutes, allow a limited number of attempts and are never stored in plain text (only their cryptographic hash linked to the document). A fully signed contract cannot be deleted from the platform. MetricTuner does not offer legal advice. We recommend consulting a lawyer specialized in intellectual property for complex legal matters.

7. Ad Campaigns

Ad campaigns created through MetricTuner run on third-party platforms (Meta Ads, Google Ads, TikTok Ads). The user is responsible for complying with each platform's advertising policies. MetricTuner provides AI copy generation and targeting tools, but the final content and its approval by the ad platforms are subject to each provider's policies. MetricTuner does not guarantee ad approval by Meta, Google or TikTok.

8. Red Semilla and Creators Portal

MetricTuner offers a feature for artists to collaborate with TikTok content creators on their campaigns. Creators operate as independent contractors, assuming their own tax responsibility for the income generated, and MetricTuner compensates them for the services rendered through independent payment systems once the content is verified and approved. MetricTuner applies a "Zero-Commission" policy on the compensation agreed with the creator.

9. API Integrations and Usage Limits

To offer automation, measurement and real-time analysis, MetricTuner connects with various third-party APIs and platforms, and implements protection and flow-control mechanisms in its own infrastructure. By using the platform, you accept that the availability and speed of these features depend on the quotas and usage limits (Rate Limits) each provider sets and on the controls we apply to preserve the stability and security of the service:

  • Advertising Modules: Automatic queries and modifications to ad platforms (Meta, Google, TikTok) are subject to each provider's quotas and usage policies. When quotas are saturated, the system applies automatic retries and waits, so some changes may be delayed or rescheduled.
  • Music and Metadata Sync: Fetching metrics and metadata from external services (streaming, link aggregators and public metadata databases) is done under adaptive limits. If a provider signals saturation, queries are paused and automatically resumed according to its instructions.
  • Internal Security Controls: We apply rate limits and automatic protections on sensitive operations —such as login, AI content generation and the issuance of temporary verification codes (OTP)— to prevent abuse, fraud and unauthorized access. For security, the specific thresholds of these controls are not published.

MetricTuner is not responsible for delays, sync failures or rejections in ad delivery resulting from third-party quota saturation or restrictions unilaterally imposed by the providers of the integrated platforms.

10. Limitation of Liability

MetricTuner is provided "as is" and "as available". We don't guarantee that the service will be uninterrupted, error-free or that it will meet specific user requirements. To the extent permitted by law, MetricTuner will not be liable for indirect, incidental, special or consequential damages arising from the use of the platform.

11. Termination

MetricTuner reserves the right to suspend or terminate your account if you violate these terms. You can delete your account at any time directly from the platform's settings section or by contacting support@metrictuner.com. When you delete your account, your personal data will be deleted in accordance with our data retention policy (maximum 90 days for complete backup deletion).

12. Artificial Intelligence and Automated Processing

MetricTuner and its affiliates use artificial intelligence and automated processing systems to deliver certain features. By using the platform, you acknowledge and accept the use of these technologies, which may run wholly or partly through third-party technology providers.

  • AI creative assistance: Automated generation of advertising copy, audience targeting suggestions and other supporting content for your campaigns. These results are indicative, may contain inaccuracies, and require your review and approval before publication.
  • Algorithmic audio processing: The audio tools apply automated algorithms to process the files you submit, which may be carried out on the infrastructure of specialized third-party providers.
  • Automated analytics and decisioning: Automated metrics-analysis and optimization systems (for example, campaign adjustments) that generate recommendations and reports from platform data and integrated sources.

MetricTuner does not guarantee the accuracy, suitability or results of automatically generated content or recommendations. The final decision and responsibility for their use rest with the user.

13. Governing Law, Individual Arbitration and Class-Action Waiver

These Terms are governed by the laws of the Republic of Colombia. For any dispute relating to the platform or to these Terms, the exclusive jurisdiction and venue shall be that of Sabaneta, Antioquia, Colombia, from where MetricTuner and its affiliates operate the service.

Prior informal resolution: Before starting any formal proceeding, the parties will attempt to resolve the dispute in good faith through written communication addressed to legal@metrictuner.com, for a period of no less than thirty (30) days.

Mandatory individual arbitration: Any dispute not resolved amicably shall be submitted to individual, confidential and binding arbitration, and not to an ordinary court, except for the exceptions permitted by applicable law.

Class-Action Waiver: To the maximum extent permitted by law, you expressly waive any right to participate in class actions, group actions or representative proceedings against MetricTuner and its affiliates. Every claim must be handled individually; claims from multiple users will not be consolidated or handled as a class or collective action.

14. User Content, Copyright and Takedown Policy (DMCA)

You are solely responsible, legally and financially, for all content that you upload, generate or link from external services on the platform, including phonograms and audio tracks, audiovisual content and videos (including those referenced via external links), graphic works (such as cover art and images), literary works and documents (the “User Content”). By providing User Content, you warrant that you own all necessary rights or hold the required licenses and authorizations over such material.

MetricTuner and its affiliates act solely as neutral intermediaries and hosting and/or linking providers for the User Content, and assume no liability for its legality, ownership or any consequences arising from it. You agree to hold MetricTuner and its affiliates harmless against any claim, damage, fine or expense (including legal fees) arising from the User Content you provide.

Takedown notice: If you believe that content hosted or linked on the platform infringes your copyright, you may report it to our Copyright Agent by writing to legal@metrictuner.com. Your notice must include:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification and location (URL) of the allegedly infringing material within the platform.
  • Your contact details: name, address, phone number and email.
  • A good-faith statement that the use of the material is not authorized by the rights holder, its agent or the law.
  • A statement that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf, together with your physical or electronic signature.

Upon receiving a valid notice, MetricTuner will remove or disable access to the allegedly infringing content. We apply an account-termination policy for repeat infringers. The affected user may submit a counter-notice in accordance with the applicable legal process.

Creator Program Terms (Red Semilla)

1. Nature of the Program

Red Semilla is a collaboration program connecting artists with TikTok content creators. Artists fund campaigns for their music to be used in videos and MetricTuner compensates creators for producing that content. Creators participate as independent contractors and are responsible for their tax obligations on the income generated.

2. Admission and Requirements

Access to the program is by application: your registration generates an application that MetricTuner reviews and approves before enabling your participation. To qualify you must: be at least 18, have a public TikTok account with a minimum of 1,000 followers, register a valid payout method, and post original content that complies with TikTok's and MetricTuner's Community Guidelines.

3. Performance-Based Payment Model

Payment per approved video consists of a fixed base of $0.25 USD plus $0.05 USD per 1,000 accumulated views, up to the maximum per-video cap the artist defines in each campaign. The amount shown upon approval is an estimate that is recalculated with the actual views at the end of the retention period. Each creator can participate with a maximum of 3 videos per campaign.

4. Delivery Deadline (SLA)

Upon accepting a campaign, the creator has a window of up to 72 hours to publish the video on TikTok and register the corresponding link in their MetricTuner panel. If the delivery isn't registered within this period, the application will expire automatically and the reserved slot will become available again to the creator community, releasing the corresponding escrow.

5. Retention Period (Escrow)

After delivering your video, the payment remains held in escrow for 14 days to verify the persistence of the post. If you delete or archive the video before that period ends, the funds are canceled and refunded to the artist. Once the period is complete, the payment is released to your available balance.

6. Welcome Bonus and Withdrawals

You can unlock up to $10.00 USD in bonuses for activity milestones (5 videos published, 25,000 accumulated views and referring an artist who activates a campaign of at least $20 USD). Withdrawals require a minimum available balance of $25.00 USD and are processed via bank transfer (Wise), PayPal or cryptocurrencies, as you configure.

7. Anti-Fraud Policy

Artificial manipulation of statistics (buying views or likes), the use of third-party content without rights, or the delivery of fraudulent links will result in account suspension and forfeiture of accumulated funds. MetricTuner reserves the right to audit creator profiles at any time.

Curator Program Terms

1. Nature of the Program

The Curators Portal lets playlist curators receive and review music submissions from artists through the platform. Access to the curator role is by application and invitation, subject to MetricTuner's review and approval, and does not require an active paid subscription. Curators manage their playlists, their request Inbox and their acceptance criteria from a dedicated dashboard.

2. Submission Types

There are two types of submission: Standard Submissions, which the curator reviews on a community basis and without compensation, and Premium Submissions, in which the artist invests credits to guarantee a review within a deadline and which generate a payment to the curator.

3. Curator Income

Curators earn income only for reviewing Premium Submissions, at $0.50 USD per credit. The cost in credits —and therefore the payment— scales with the playlist's size: from $0.50 (playlists under 5,000 followers) up to $2.50 per review (playlists with 100,000 or more followers). To receive Premium Submissions, a playlist must reach at least 1,000 real followers and have its monetization approved. Payment is credited both when approving a submission and when rejecting it with feedback.

4. Review Obligations

Each Premium Submission must be reviewed within a 7-day period; otherwise, the credits are automatically refunded to the artist and no payment is generated for the curator. Rejecting a Premium Submission requires constructive feedback of at least 10 characters. The curator's requirements (such as following the playlist or saving the song) are completed manually by the artist before submitting their request and, when the playlist requires it, their contact is added to the curator's CRM.

5. Withdrawals and Anti-Fraud

Income is credited to the curator's wallet and can be withdrawn from a minimum balance of $25.00 USD via bank transfer (Wise). Playlists must grow with real followers: buying followers, using bots or manipulating metrics leads to monetization revocation, exclusion of the affected playlists and account suspension. Privacy Policy

Executive summary: We collect the minimum data necessary to operate the platform. We don't sell your data to third parties. We rely on specialized service providers (payment processing, infrastructure, email and ad platforms) for specific features; each one processes only the data essential to its function. We comply with GDPR, CCPA/CPRA and equivalent regulations.

1. Data We Collect

Account data: Name, email address, password (stored securely), profile photo (if you use Google OAuth), artist name, IPI, ISNI, social networks, and (in the case of content creators who collaborate with the platform) linked TikTok account, niches and the payout details they provide so we can compensate them for their services.

Usage data: Platform interactions, features used, access timestamps, IP address, browser type and operating system.

Fan data (as Processor): When a fan interacts with your Smart Link, Content Gate or Pre-Save, we collect their email (if voluntarily provided), preferred streaming platform and interaction timestamp. This data belongs to the artist/user who created the link — MetricTuner acts as Data Processor, and the artist/user as Data Controller.

Payment data: Card data is processed exclusively by our payment provider (Paddle). MetricTuner never stores or has access to card numbers. We only keep a provider customer identifier and your subscription status. To compensate collaborators who provide services on the platform, we store only the payout data they provide (e.g. payment email or receiving account details).

Digital signature data: For Split Sheets, we record IP address, browser agent, date, time and verified OTP code of each signer as part of the legally required audit trail.

Local Storage (LocalStorage): We store local information temporarily in your browser to manage your session and the proper functioning of the platform's features.

2. How We Use Your Data

  • Service operation: Authentication, account management, subscription processing and feature delivery.
  • Analytics and metrics: Syncing data from streaming platforms for your Artist Intelligence panel.
  • Marketing and advertising: Running the ad campaigns you set up on Meta, Google and TikTok. Use of tracking pixels (Meta Pixel, TikTok Pixel, Google Analytics) on your Smart Links when you enable them.
  • Communications: Sending transactional emails (OTPs, confirmations, status notifications) and, with your consent, marketing communications.
  • Security: Fraud prevention, misuse detection and access auditing.
  • Service improvement: Aggregated and anonymized analysis of platform usage to improve features.

3. Legal Basis for Processing (GDPR)

  • Contract performance: We process your data to provide the service you subscribe to.
  • Consent: For non-essential cookies, tracking pixels and marketing communications.
  • Legitimate interest: For fraud prevention, platform security and service improvement.
  • Legal obligation: For Split Sheet audit trails and compliance with tax regulations.

4. Data Retention

We keep your account data while your account is active. Fan data in your CRM is kept as long as you keep it on the platform. After your account is deleted, personal data is removed within a maximum of 90 days (including backups). Split Sheet audit trails are kept indefinitely due to legal evidentiary documentation requirements.

5. Tracking Technologies and Collection on Public Pages

Public, fan-facing pages (such as Smart Links, Content Gates, Pre-Saves and artist pages) may include third-party analytics and marketing cookies and pixels, activated by the artist or by the platform, in order to measure engagement and optimize advertising campaigns. These technologies may process device identifiers, IP address and browsing data.

We may also use server-side integrations to securely forward limited interaction events to advertising and analytics providers, in order to improve campaign measurement.

When a fan voluntarily interacts with these pages (for example, by unlocking a Content Gate, performing a Pre-Save or subscribing), we may collect personally identifiable information such as their name and email address, which is added to the relevant artist's audience/CRM. The artist acts as the controller of such data and MetricTuner as the processor.

You can manage or reject non-essential cookies from your browser settings, and fans can unsubscribe from marketing communications at any time via the unsubscribe link included in every email.

Cookie Policy

MetricTuner uses cookies and similar technologies for the following purposes:

Essential

Authentication and user session maintenance, language preferences and account settings. They cannot be disabled as they are necessary for the proper functioning of the platform.

Analytics

Aggregated analysis of platform usage to improve features. They are only activated with your prior consent.

Tracking Pixels

Meta Pixel, TikTok Pixel and Google Analytics. They are installed only on the Smart Links and Content Gates where the artist has voluntarily enabled them for their retargeting campaigns.

Third-Party

Cookies from our essential service providers (payment processing, server infrastructure and stability monitoring). These cookies are strictly operational.

MetricTuner does NOT sell, rent or trade personal data to third parties. We comply with CCPA "Do Not Sell or Share My Personal Information".

How to exercise your rights?

Send an email to privacy@metrictuner.com with your request. We'll respond within a maximum of 30 days (per GDPR) or 45 days (per CCPA). To verify your identity, we'll ask you to confirm from the email associated with your account.

Protection of Minors

MetricTuner is not directed at minors under 18. We don't intentionally collect data from minors under 13 (or the applicable minimum age in your jurisdiction). If we discover we have collected a minor's data, we will delete it immediately. If you're a parent or guardian and believe your child has provided data to MetricTuner, contact privacy@metrictuner.com.

Data Security

We implement robust technical and organizational security measures to protect your personal data against loss, theft, alteration or unauthorized access. This includes industry-standard encryption (SSL/TLS) for all data transmissions, secure password storage via one-way cryptographic functions, secure session cookie configuration, and strict access controls to our databases. Additionally, we apply automatic redaction filters in our event logging and monitoring systems to prevent the accidental storage of credentials or sensitive information. All payment data is processed exclusively through our payment provider (Paddle), in accordance with the payment card industry's security standards (PCI-DSS).

Changes to This Policy

We reserve the right to update this policy at any time. Substantial changes will be notified by email at least 30 days in advance. The last-updated date will always be shown at the top of this document.
